Acceptance of personal training will be deemed to include acceptance of the following terms and conditions.

All sessions are 55 minutes and will be conducted at the FX Fitness Studio. Any extension in length of session is at the discretion of FX Fitness, and may be subject to additional charge, subject to Client agreement. Time, date and frequency of sessions are subject to prior arrangement with FX Fitness.

The first session will be free of charge and will consist of a meeting to introduce ourselves and discuss your requirements, as well as allowing you to sample some of our training techniques which we will use to help you achieve your goals.

All sessions and blocks of sessions must be paid for in advance on first session or on date of renewal of block. FX Fitness reserves the right to cancel sessions if payment is not received.

We operate a 24hr cancellation policy – If a client does not cancel or reschedule an appointment at least 24 hours in advance by phone or email, or if a client fails to appear for a scheduled appointment, FX Fitness reserves the right to charge a cancellation fee equivalent to a full personal training fee that would normally be charged for that training session. Emergency cancellations will be treated at the discretion of FX Fitness.

Clients are required to attend a training session at the published commencement time. If the client is late for a session the session cannot be extended and will end at the appointed time. If a client arrives early, they should not expect to be seen early, as there are often clients in prior to the published commencement time – please wait until your session is due to commence prior to entering.

Once a payment for purchase of a package or service from FX Fitness is made there will be no refunds allowed. The client is required to give a month’s notice to discontinue training.

Any session that remains dormant in credit to you for a period of more than 4 months will be conceded. Sessions may be transferred to another person should you be unable to attend your sessions due to illness.

Refunds are only applicable when illness inhibits continuation (a doctors certificate will be required as proof).

Except as otherwise expressly agreed by FX Fitness, the price of each session or block of sessions shall be the price listed in FX Fitness’s published price list current at the date of purchase (subject to any volume discounts set out in the price list). The price of services is subject to change at any time at FX Fitness’s sole discretion prior to the date of purchase. You must check the Website or other published price list for the current prices before booking any services.

Payment for all services shall be made by BACS or other online money transfer services as may be specified by FX Fitness.

The Client is responsible for their own personal medical requirements, clothing and footwear for the duration of the Services. The client is required to wear appropriate clothing and footwear. Clothes should be loose fitting and non-restrictive. Footwear should be comfortable and provide adequate support. Clients are expected to bring their own refreshments and towels.

It is understood between client and trainer that both must commit to the programme 100% in order to achieve results.

Personal training involves physical exertion. A physical activity questionnaire (PAR-Q) must be completed by the client prior to commencement of exercise and, where necessary, provide a doctor’s certificate for authorisation to exercise. Please click on this link to download a PAR-Q form.

Clients wishing to engage in training in pairs must note that a similar level of fitness is required. Differing abilities or goals may require two trainers which may incur additional costs. Please discuss this with FX Fitness prior to booking.

FX Fitness do not undertake to provide clients with medical advice on the basis of information contained in the completed PAR-Q, and that the information is used solely to establish the client’s limitations and their ability to exercise. If FX Fitness requires further medical information from a practitioner, the client must provide such details.

Acceptance of services will be deemed as confirmation by the client that they voluntarily wish to engage in an acceptable level of exercise which has been prescribed by FX Fitness.

A Client may not use any of FX Fitness facilities or attend a training session whilst suffering from any infection or contagious illness that could affect others. If you suspect that you are coming down with any illness, please contact FX Fitness to rearrange your session. If you attend your session whilst ill, FX Fitness reserve the right to terminate the session immediately and charge for the cost of the session in full.

If FX Fitness personnel believe a Client’s health or safety is at risk, or a Client has failed to disclose either verbally or via the PAR-Q form any relevant health information prior to commencement of the first session, then FX Fitness may at its absolute discretion make decisions affecting the Client and where necessary may terminate the session and subsequent sessions immediately.

Clients who willfully or negligently abuse and or damage any of FX Fitness’s facilities and or equipment will be liable to pay for any such damage.

FX Fitness (its directors, employees and freelance contractors) do not accept any liability whatsoever for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the services purchased from us or any other damage howsoever caused.

Please note that the FX Fitness Jersey will only collect your personal information for the purposes of your enquiry and any future personal training sessions, remote programming or movement and body composition assessments. We will not pass any of your information to any third parties without asking you first, unless required by law to do so.

We will keep your information for up to 1 year after you cease training with FX Fitness, after which it will be securely deleted from our records.

We do not use your information for marketing purposes, nor do we make automated decisions about you. Should you wish to exercise your right of access to the information we hold about you, you can do so in writing to Dan Garrido at info@fx-fitness.co.uk You also have a right to complain to the Office of the Information Commissioner if you are unhappy with the way we are handling your information.

None of the exclusions and limitations in these conditions are intended to limit any rights the Client may have under statute or common law which may not be excluded; nor in any way to exclude or limit liability to the Client for personal injury or death resulting from FX Fitness’s negligence or that of its employees or agents; or for any liability incurred as a result of fraud or fraudulent misrepresentation by FX Fitness.

FX Fitness carries public liability insurance for personal injury (including sickness and death) where such injury results from FX Fitness’s negligence.

FX Fitness reserves the right to change these Terms from time to time without the written agreement of the Client subject to notice. The Client is responsible for regularly reviewing these Terms and any amended terms posted on the Website or otherwise notified to you.
